In this Privacy Policy, ‘us’ ‘we’ or ‘our’ means Bleasdale National Contractors Pty Ltd (ABN 98 460 488 316) (BNC) and our related bodies corporate. We are committed to respecting your privacy, and as a result we have created this Privacy Policy to align with applicable data protection legislation (including the European General Data Protection Regulation (Regulation (EU) 2016/679) and the Privacy Act 2001 (Cth)) and any other legislation in force which applies relating to either or both privacy or the handling of personal data (the “Data Protection Legislation”).

Our Privacy Policy aims to clearly outline our policies and procedures for collecting, using, storing and disclosing personal data of individuals. All of the different forms of data, content, and information described in this Privacy Policy are collectively referred to as “personal data”.

Our service offering involves providing organisations and individuals within those organisations with access to and use of the BNC Workforce Application (“BNC Application”) and the BNC Website, together known as the “Service”, through their devices (any computer used to access the BNC Application, including without limitation a desktop, laptop, mobile phone, tablet, or other consumer electronic device (each a “Device”).

This Privacy Policy explains what we do with your personal data when:

  • your organisation signs up to the Service and you access the BNC Application using a business account via our website (www.bleasdales.com.au), subdomain (*.bleasdales.com.au), through applications on devices, through APIs, or through third-parties (together, the “Application Users”);
  • you leave your organisation and cease to access the BNC Application using a business account attached to your organisation (“Former Application User”);
  • you visit our website (www.bleasdales.com.au) and subdomain (*.bleasdales.com.au) (the “Website”) while browsing the internet (together, the “Website Users”); and
  • you call our customer service team or sales team for any purpose (“Phone User”).

If you are an Application User, our primary purpose for using your personal data is to provide the Service to your organisation. When we use your personal data to allow you to access and use the BNC Application, we do so on the instructions of your organisation and on behalf of your organisation. This makes us a “data processor” for the purposes of the Data Protection Legislation. However, there may be certain circumstances under which we use your personal data for purposes that are not on behalf of your organisation or in accordance with instructions of your organisation, for example, where we need to use it for our own purposes. Under these circumstances, we are a “data controller” for the purposes of the Data Protection Legislation. Please see the below sections for more information.

If you are a Former Application User, we may retain your personal data to maintain a limited version of your business account profile and for our own purposes, for example, where we wish to offer you services which we think you may be interested in. This makes us a “data controller” for the purposes of the Data Protection Legislation. Please see the below sections for more information.

If you are a Website User, we use your information for our own purposes. This makes us a “data controller” for the purposes of the Data Protection Legislation. Please see the below sections for more information.

By providing personal information to us, you consent to our collection, use and disclosure of your personal information in accordance with this Privacy Policy and any other arrangements that apply between us. We may change our Privacy Policy from time to time by publishing changes to it on our website. We encourage you to check the the BNC website periodically to ensure that you are aware of our current Privacy Policy.

Personal information includes information or an opinion about an individual that is reasonably identifiable. For example, this may include your name, age, gender, postcode and contact details. It may also include financial information, including your credit card information.

What personal information do we collect?

We may collect the following types of personal information:

  • name;
  • mailing or street address;
  • email address;
  • telephone number and other contact details;
  • age or date of birth;
  • gender;
  • contacts (through social network connection services or email integrations that you authorise);
  • credit card information or other billing information;
  • your device ID, device type, geo-location information, computer and connection information, statistics on page views, traffic to and from the sites, ad data, IP address and standard web log information;
  • any further personal data contained in any files that you upload, download, or create (“Files”) within the BNC Application;
  • log data from your Device, its software, and your activity using the BNC Application including the Device’s Internet Protocol (“IP”) address, browser type, locale preferences, geo-Location Information, identification numbers associated with your Devices, your mobile carrier, date and time stamps associated with transactions, system configuration information, metadata concerning your Files, and other interactions with the BNC Application;
  • details of the products and services we have provided to you or that you have enquired about, including any additional information necessary to deliver those products and services and respond to your enquiries;
  • any additional information relating to you that you provide to us directly through our website or app or indirectly through your use of our website or app or online presence or through other websites or accounts from which you permit us to collect information;
  • information you provide to us through customer surveys; or
  • any other personal information that may be required in order to facilitate your dealings with us.

We may collect these types of personal information either directly from you, or from third parties. We may collect this information when you:

  • register on our website or app;
  • communicate with us through correspondence, chats, email, or when you share information with us from other social applications, services or websites;
  • provide personal data to us when you use the BNC Application, when you contact us via the BNC Application, and/or when you upload, download, or create Files within the BNC Application.
  • interact with our sites, services, content and advertising; or
  • invest in our business or enquire as to a potential purchase in our business.

We may also collect these types of personal information when:

  • your organisation and other sources provide personal data about you;
  • other Application Users provide personal data (for example, your email address) through other Application Users, if they have invited you to their BNC account; and
  • we collect your personal data automatically via cookies, in line with cookie settings in your browser. If you would like to find out more about cookies, including how we use them and what choices are available to you, please see the section titled “Using our website and cookies”.

In addition, when you apply for a job or position with us we may collect certain information from you (including your name, contact details, working history and relevant records checks) from any recruitment consultant, your previous employers and others who may be able to provide information to us to assist in our decision on whether or not to make you an offer of employment or engage you under a contract.

This Privacy Policy does not apply to acts and practices in relation to employee records of our current and former employees, which are exempt from the Privacy Act.

Why do we collect, use and disclose personal information?

We may collect, hold, use and disclose your personal information for the following purposes:

  • to enable you to access and use our services;
  • to operate, protect, improve and optimise our services, business and our users’ experience, such as to perform analytics, conduct research and for advertising and marketing;
  • to send you service, support and administrative messages, reminders, technical notices, updates, security alerts, and information requested by you;
  • to send you marketing and promotional messages and other information that may be of interest to you, including information sent by, or on behalf of, our business partners that we think you may find interesting;
  • to administer rewards, surveys, contests, or other promotional activities or events sponsored or managed by us or our business partners;
  • to comply with our legal obligations, resolve any disputes that we may have with any of our users, and enforce our agreements with third parties; and
  • to consider your employment application.

We may also disclose your personal information to a trusted third party who also holds other information about you. This third party may combine that information in order to enable it and us to develop anonymised consumer insights so that we can better understand your preferences and interests, personalise your experience and enhance the products and services that you receive.

Do we use your personal information for direct marketing?

We and/or our carefully selected business partners may send you direct marketing communications and information about our products and services. This may take the form of emails, SMS, mail or other forms of communication, in accordance with the Spam Act and the Privacy Act. You may opt-out of receiving marketing materials from us by contacting us using the details set out below or by using the opt-out facilities provided (e.g. an unsubscribe link).

To whom do we disclose your personal information?

We may disclose personal information for the purposes described in this privacy policy to:

  • our employees and related bodies corporate;
  • third party suppliers and service providers (including providers for the operation of our websites and/or our business or in connection with providing our products and services to you);
  • professional advisers, dealers and agents;
  • payment systems operators (eg merchants receiving card payments);
  • our existing or potential agents, business partners or partners;
  • our sponsors or promoters of any competition that we conduct via our services;
  • anyone to whom our assets or businesses (or any part of them) are transferred;
  • specific third parties authorised by you to receive information held by us; and/or
  • other persons, including government agencies, regulatory bodies and law enforcement agencies, or as required, authorised or permitted by law.

How can you access, amend or take back the personal data that we hold about you?

You have various rights in relation to the personal data that we hold about you. To get in touch about these rights, please contact us or your organisation.

If you are an Application User and you wish to make a request in relation to our use of your personal data for the purposes of providing the Service to your organisation (and in respect of which we are a data processor), please contact your organisation in the first instance to handle your request. If you contact us, we will refer your request to your organisation.

If you are an Application User and you wish to make a request in relation to our use of your personal data which is unconnected to your organisation or you are a Former Application User or a Website User, please contact us and we will handle your request.

The Data Protection Legislation gives you the following rights in relation to your personal data:

  • Right to object: this right enables you to object to us processing your personal data;
  • Right to withdraw consent: Where we have obtained your consent to process your personal data for certain activities (for example, sharing your information with a third party application), you may withdraw this consent at any time and we will cease to carry out that particular activity that you previously consented to unless we consider that there is an alternative legal basis to justify our continued processing of your personal data for this purpose, in which case we will inform you of this condition;  
  • Data Subject Access Requests (DSAR): You may ask us to confirm what information we hold about you at any time, and request us to modify, update or delete such information. You may also request a copy of the information we hold about you;
  • Right to erasure: You have the right to request that we “erase” your personal data in certain circumstances. We will try to delete your personal data quickly upon request and if desired make it available to you. While we will endeavour to permanently erase or return your personal data upon request, some of your personal data may still exist within our systems, for example if it is waiting to be overwritten. For our purposes, this personal data has been put beyond use, meaning that, while it still exists in the electronic ether, our employees will not have any access to it or use it again. We may retain and use your personal data if we believe that the law or other regulation requires us to preserve it (for example, because of a request by a tax authority or in connection with any anticipated litigation) or if we require it to enforce our agreements. If you are an Application User connected with an organisation, we shall not delete or edit your personal data without the approval of your organisation;
  • Right to restrict processing: You have the right to request that we restrict our processing of your personal data in certain circumstances, for example if you dispute the accuracy of the personal data that we hold about you or you object to our processing of your personal data for our legitimate interests. If we have shared your personal data with third parties, we will notify them about the restricted processing unless this is impossible or involves disproportionate effort. We will, of course, notify you before lifting any restriction on processing your personal data;
  • Right to rectification: You also have the right to request that we rectify any inaccurate or incomplete personal data that we hold about you, including by means of providing a supplementary statement. If we have shared this personal data with third parties, we will notify them about the rectification unless this is impossible or involves disproportionate effort. You may also request details of the third parties that we have disclosed the inaccurate or incomplete personal data to. Where we think that it is reasonable for us not to comply with your request, we will explain our reasons for this decision;
  • Right of data portability: If you wish, you have the right to request that we transfer your personal data to another third party. To allow you to do so, we will provide you with your personal data in a commonly used machine-readable format so that you can transfer the data. Alternatively, we may directly transfer the personal data for you. This right of data portability only applies to certain types of personal data;
  • Right to lodge a complaint with a supervisory authority: You also have the right to lodge a complaint with the relevant supervisory authority in your jurisdiction.

Disclosure of personal information outside Australia

We may disclose personal information outside of Australia to our development teams (based in Australia and India).

When you provide your personal information to us, you consent to the disclosure of your information outside of Australia and acknowledge that we are not required to ensure that overseas recipients handle that personal information in compliance with Australian Privacy Law.

We will, however, take reasonable steps to ensure that any overseas recipient will deal with such personal information in a way that is consistent with the Australian Privacy Principles.

Using our website and cookies

We may collect personal information about you when you use and access our website.

While we do not use browsing information to identify you personally, we may record certain information about your use of our website, such as which pages you visit, the time and date of your visit and the internet protocol address assigned to your computer.

We may also use ‘cookies’ or other similar tracking technologies on our website that help us track your website usage and remember your preferences. Cookies are small files that store information on your computer, TV, mobile phone or other device. They enable the entity that put the cookie on your device to recognise you across different websites, services, devices and/or browsing sessions. You can disable cookies through your internet browser but our websites may not work as intended for you if you do so.

For example, where a cookie is linked to your account, it will be considered personal information under the Privacy Act. We will handle any personal information collected by cookies in the same way that we handle all other personal information as described in this Privacy Policy.

We may hold your personal information in either electronic or hard copy form. We take reasonable steps to protect your personal information from misuse, interference and loss, as well as unauthorised access, modification or disclosure and we use a number of physical, administrative, personnel and technical measures to protect your personal information. However, we cannot guarantee the security of your personal information.

Unless expressly stated otherwise, we are not responsible for the privacy practices of, or any content on, those linked websites, and have no control over or rights in those linked websites. The privacy policies that apply to those other websites may differ substantially from our Privacy Policy, so we encourage individuals to read them before using those websites.

Accessing or correcting your personal information

You can access the personal information we hold about you by contacting us using the contact us function. Sometimes, we may not be able to provide you with access to all of your personal information and, where this is the case, we will tell you why. We may also need to verify your identity when you request your personal information

If you think we have breached the Privacy Act, or you wish to make a complaint about the way we have handled your personal information, you can contact us using the details set out below.

Please include your name, email address and/or telephone number and clearly describe your complaint. We will acknowledge your complaint and respond to you regarding your complaint within a reasonable period of time. If you think that we have failed to resolve the complaint satisfactorily, we will provide you with information about the further steps you can take.
